Properties within the Village of Carey that are in foreclosure are often left vacant and in deteriorating condition; and the Village has an interest in ensuring that properties within the Village are maintained for the health, safety, and welfare of Village residents. Any individuals and or companies that foreclose on properties within the Village have an obligation to ensure that they are adequately maintained in accordance with the Village Zoning Ordinance, property Maintenance Code, and other applicable ordinances of the Village.
Therefore, any person who files a complaint in any court of competent jurisdiction for foreclosure involving real property located within the Village shall notify the Village of the filing of the foreclosure complaint within thirty (30) days after the filing of the complaint. The notice shall contain the following information:
a. A statement as to whether the person filing the foreclosure has knowledge that the property is vacant or occupied.
b. The name, address, and contact information for the person who is responsible for maintaining the property during the foreclosure process in compliance with applicable ordinances of the Village.
c. A copy of the foreclosure complaint.
Upon the sale of the property, the person filing the foreclosure complaint, or any agent, assignee, or transferee thereof, shall notify the Village of the name, address, and contact information for the buyer within 10 days of the sale.
All notices referenced herein shall be directed to the Village Administrator.
